TERMS OF SERVICE

1. SERVICE DESCRIPTION
Refresh Filters Group, Inc. ("Company," "we," "us," or "our"), provides a subscription-based pool filter cleaning service ("Service") where we remove, clean, and install pool filters in your pool equipment according to the subscription plan you select.
2. ACCEPTANCE OF TERMS
By subscribing to our Service, you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
3. SUBSCRIPTION AND BILLING
You agree to subscribe to a minimum number of cleaning services as specified in your selected plan. If you choose monthly billing, you commit to a minimum of 9 consecutive monthly payments corresponding to your subscription term. Early termination fees may apply if you cancel before completing your minimum subscription term. Subscription fees are billed automatically according to your selected payment schedule. No refunds will be given for any unused services. Prices are subject to change with 30 days' notice. Unpaid balances may incur a late fee of 1.5% per month. Returned checks or failed automatic payments will incur a $25.00 processing fee. We reserve the right to suspend service if payment is not received within 30 days of the payment due date. 30 days of the payment due date.
4. EQUIPMENT AND SERVICING
Our Service includes removal of your existing filter, replacement with a clean filter, and off-site cleaning of your removed filter. The filter reinstalled in your pool may not be your original filter but will be a properly cleaned and serviced filter of the same type and compatible specifications. You acknowledge and agree that filters may be interchanged between customers as part of our service model. All filters are thoroughly cleaned, sanitized, and inspected before installation. Our standard service does not include chemical testing or adjustment, water balancing, or other pool maintenance beyond filter cleaning. Filter cleaning frequency recommendations are based on industry standards and our professional assessment of your pool's needs.
5. EQUIPMENT DISCLAIMER AND LIABILITY LIMITATIONS
The Company is not liable for:
- Any pre-existing damage or wear to your pool filter system not caused by our service
- Normal wear and tear of filter equipment
- Issues arising from compatibility of our service with unusual or non-standard pool systems
- Water quality or chemical balance issues not directly caused by our service
- Any consequential damages related to pool system operation
- Damage caused by weather, lawn services, construction, pets, or vandalism
- Damage resulting from equipment breakdowns, malfunctions, or design defects
- Issues related to manufacturer's defects or recalls
Our maximum liability is limited to the replacement cost of the filter element itself. You acknowledge that filter interchange between customers is an essential aspect of our service model. In no event shall our total liability exceed the amount paid by you for services within the three (3) months prior to any claim.
6. ACCESS AND SCHEDULING
You agree to provide safe access to your pool equipment during scheduled service times. Missed appointments without 24-hour notice may count toward your subscription minimum and may incur additional fees. Service visits will be scheduled on a regular basis according to your subscription plan. We will make reasonable efforts to maintain consistent service days, but schedules may vary due to holidays, weather, or other circumstances. If pets are present on the property, you must secure them during scheduled service times. The Company may photograph your pool equipment for service documentation purposes.
7. TERMINATION
You may cancel your subscription after completing the minimum required service period without penalty. Cancellation before completion of the minimum service period may result in early termination fees. We reserve the right to terminate service due to unsafe conditions, repeated inaccessibility, or non-payment. Cancellation requests must be submitted at least 30 days prior to your next billing cycle. Upon termination, you will be responsible for all outstanding balances.
8. MODIFICATIONS
We may modify these Terms of Service at any time by posting the revised terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
9. FORCE MAJEURE
Neither party shall be in default or otherwise liable for any delay in or failure of its performance under this Agreement if such delay or failure arises by any reason beyond its reasonable control, including any act of God, acts of civil or military authorities, acts of terrorism, civil disturbances, wars, strikes or labor disputes, fires, transportation contingencies, interruptions in telecommunications, utility, electrical or network services. The affected party will promptly notify the other party of the circumstances causing its delay or failure to perform.
10. INITIAL SERVICE
The initial service visit will include an assessment of your pool filter system's condition and needs. Based on this assessment, we may determine that your pool requires a different cleaning frequency or service plan than initially selected. If we identify any issues or special circumstances during this assessment, we may recommend adjustments to your subscription plan. You will be notified of any recommended changes and associated price adjustments before proceeding with the adjusted service plan. Your continued use of our services after being notified of these adjustments constitutes your acceptance of the revised plan.
11. CUSTOMER RESPONSIBILITIES
Maintaining proper water chemistry between service visits. Ensuring electricity and water supply to pool equipment is operational. Informing us of any changes to pool equipment or conditions. Removing objects from the pool area that may impede service. Notifying us of vacation periods or property changes that may affect service. Keeping all payments current according to agreed terms.
12. SEVERABILITY
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect and enforceable.
13. ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between you and the Company regarding the subject matter hereof and supersedes all prior or contemporaneous communications, whether electronic, oral, or written.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation or breach of any terms of these Terms of Service.
15. GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
16. DISPUTE RESOLUTION
Any dispute arising out of or relating to these Terms of Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation, both parties agree to resolve the dispute through mediation in the State of Arizona before resorting to arbitration or litigation.
